Terms & Conditions

By booking a dive or service with Sub Culture, you (the “Client” or “Diver”, “Snorkeler”, “Visitor”, “Tourist” or “Adventurer”) agree to the following Terms and Conditions. Please read them carefully before finalizing your reservation.

1. SECURING YOUR SLOT (BOOKING & PAYMENTS)
  • Deposits: To finalize your booking and reserve your space on our boat, we require a deposit per person. This deposit is payable exclusively via our official reservations portal.

    As availability is limited and last-minute changes can significantly impact our operations and the company’s financial planning, securing your booking with a deposit helps us plan accordingly and ensure the best experience for all guests.

  • The Balance: The remaining balance of your dive package must be paid in full upon arrival, strictly before your first descent.

Please take note there are no cash machines at the Marina. We reserve the right to provide the exchange rate.

  • Scaling Your Trip: We want you to dive as much as you want. You are welcome to add on additional dives as your trip progresses, provided that space is available on the boat.
  • Gratuities (Tips / Propinas): If you receive excellent service, gratuities are greatly appreciated and are customary in Mexico. While not mandatory, tipping is a common practice in the diving industry. As a general guideline, divers often choose to tip between $20–$50 USD per person, depending on their experience. All gratuities are shared among the team.
  • Official Channels: Please make sure you secure your scale up or booking via the official booking channels, the web portals or via email only.
2. THE “SMALL BOAT” REALITY & COMMITMENT

Please bear in mind that Sub Culture operates as a boutique dive operation with strictly limited capacity. Every slot on our boat is vital to our daily operations.

  • The Impact of Changes: When clients make last-minute changes or fail to show up, it creates an opportunity cost—it prevents other eager divers from joining us and severely impacts our daily logistics.
  • Our Request: By making a reservation, we ask that you treat your scheduled dive slots as confirmed, binding commitments.
3. CANCELLATION & REFUND POLICY

Due to our limited capacity, we enforce a strict cancellation policy based on the notice provided prior to your scheduled dive date. All eligible refunds are subject to the deduction of a standard transaction fee.

  • 30+ Days Notice: 100% refund of your deposit (minus a 4.9% transaction fee).
  • 30 Days to 1 Week Notice: 50% refund of your deposit (minus a 4.9% transaction fee).
  • Up to 24 Hours Notice: 25% refund of your deposit (minus a 4.9% transaction fee).
  • Within 24 Hours & No-Shows: No refunds will be issued for cancellations made within 24 hours of your scheduled trip, or for any cancellations made during your actual reservation dates.
4. WEATHER & PORT CLOSURES

Diving is a weather-dependent activity. If the local harbor is officially closed by the Port Captain / Authorities (Capitanía de Puerto), preventing our boats from leaving:

  • We offer a full refund for any unused dives, OR
  • A credit toward a future dive trip with Sub Culture.

We may provide a port closure report if you have travel insurance and wish to redeem any activity that impacts our daily logistics, income and profit margin.

5. HEALTH, SAFETY & SOBRIETY POLICY

Our absolute priority is the safety of our crew and all divers on board.

  • Sobriety Policy: Scuba diving and alcohol/substances do not mix. Please note that a hangover does not qualify as being sick. Sub Culture reserves the right to refuse service and prevent you from diving if our crew senses you have been partying or are under the influence of drugs or alcohol from the night before. In these cases, no refund will be issued.
  • Medical Refunds: If you are genuinely unable to dive due to illness and require a refund outside of our standard cancellation window, we require a formal doctor’s note specifically from CMC (Dr. Darío Gómez).
6. CERTIFICATION & LIABILITY (Standard Diving Additions)
  • Proof of Certification: Unless you are participating in a beginner course (e.g., Discover Scuba Diving), you must present a valid Scuba Diving Certification Card from a recognized agency (PADI, SSI, SDI, etc.) prior to diving.
  • Liability Waiver: Prior to boarding the vessel or entering the water, all divers must read, fill out, and sign a standard Medical Questionnaire and Assumption of Risk / Liability Release form. Failure to complete these documents will result in the cancellation of your dive without a refund.
7. GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of Mexico. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the local courts in the state where Sub Culture operates.
